Visa Cancellation Overturned November 2011

Phillip Silver and Associates Lawyers (Australia) recently recorded a significant legal victory on behalf of a client (whose visa had been cancelled by the Department of Immigration and Citizenship) and successfully overturned a visa cancellation in a judgement handed down in the Federal Magistrate’s Court in Sydney on 11 November 2011.

The case, personally managed by Phillip Silver, was significant in that the court held the legal argument we submitted was of sufficient significance and substance to convince the court that both the first and second defendants (The Minister for Immigration and Citizenship and the Migration Review Tribunal respectively) had erred in the manner in which they had interpreted and applied the law in cancelling the visa concerned.

What makes this case especially significant is that the Minister was represented by a very large Australian law firm, thus highlighting our strong belief that ‘It is not about the size of the law firm in the fight but the size of the fight in the law firm,’ a principle proven time and again and one that has contributed significantly to high success rate of Phillip Silver and Associates, in even the most challenging cases.
